These terms are an agreement between you (the business that signs up) and Pure Basket Co (Pty) Ltd, trading as FreshKept ("we").
FreshKept lets your staff record food-safety checks (such as temperatures and cleaning) by phone, and gives you reports of those records. It helps you keep the records Regulation R638 asks for. It does not replace your own responsibility for food safety, and we can't guarantee the outcome of any inspection.
New accounts get a 14-day free trial. No card is needed. After the trial, your staff can keep logging checks, but reports are locked until you subscribe.
The price is R149 per site per month, or the price shown when you subscribe. A site is one business location at one address; each site needs its own account. You pay monthly in advance by card through Paystack, which charges the same card each month. Prices exclude VAT; if we register for VAT, we will add it and tell you 30 days before it applies. We may change prices with 30 days' notice; founding-customer prices are kept for the period promised.
If a payment fails, we'll ask you to update your card. Staff can keep logging, but reports lock if payment is still outstanding a few days after your paid-up date.
You can cancel at any time from the Billing page. You keep full access until the end of the month you have paid for, and you won't be charged again. We don't refund part months.
Your records belong to you. You can download all of them at any time, even if you haven't paid. Records can't be changed or deleted once saved, so they can be trusted as evidence. We keep them while your account is open and for 3 years after it closes, then delete them.
Keep your login and staff PINs private, make sure readings are taken properly with a working thermometer, and act on problems the app shows you. Don't use the service for anything unlawful.
We work to keep the service running at all times, and checks can be saved on the phone without signal. Occasionally it may be unavailable for maintenance or reasons outside our control.
As far as the law allows, we are not liable for indirect losses, and our total liability to you is limited to the fees you paid us in the 3 months before the claim. Nothing in these terms limits your rights under the Consumer Protection Act where it applies.
We may update these terms and will tell you about important changes 30 days in advance. We may transfer this agreement to a related or successor company that takes over the service, on the same terms; we will tell you if this happens.
We handle personal information as set out in our privacy notice and under POPIA. These terms are governed by South African law.
